A Zimmer Durom Cup class action is an action taken on behalf of two or more individuals who have suffered harm from this medical device. In mid-September 2009, the first of many potential class action suits regarding the Zimmer Durom Cup was started by a California law firm. Eight individuals in the Bakersfield area are suing the manufacturer and distributor of the Durom Cup Resurfacing System, Zimmer Inc., an Indiana-based corporation.
The eight patients had received a Zimmer Durom Cup hip implant and then experienced problems severe enough to warrant a second surgery as treatment for the implant issues. The plaintiffs' attorney, Matthew Faulkner, contends that bone and body tissues don't grow into the Durom Cup properly, and that the Cups need to be replaced with parts from a different implant.
Attorneys for Zimmer have already responded to the eight plaintiffs' court filings, stating that any problems with the Durom Cup can be traced to the physicians who implanted the products, or to the patients' unique conditions. However, as Mr. Faulkner noted, Zimmer stopped all sales of the Durom Cup for several months in 2008 and distributed new instructions to surgeons on how to implant this product.
