Zicam lawsuits have been filed because of the condition called anosmia, or a loss of smell. Anosmia is the total loss or impairment of the sense of smell, and when anosmia occurs, the damage might be temporary or permanent without reversible damage.
A Zicam lawsuit filed in October 2003 alleged the use of Zicam caused anosmia to be suffered after a single application. A September 2003 meeting of the American Rhinologic Society discussed several cases similar to the lawsuit filing, and the case report authors have stated the direct application to the inner lining of the nose has long been known to cause a loss of smell. The Zicam lawsuits have alleged Zicam Cold Remedy nasal gel is defective and unreasonably dangerous when used according to labeling directions.
Naming Zicam LLC and Matrixx Initiatives, the Zicam lawsuits have included counts for strict products liability, negligence, breach of warranties, common law fraud, consumer fraud, and negligent misrepresentation. Complaints surrounding the use of Zicam have included the sensation of stinging and burning in the nose. Since different senses interact with one another, anosmia also affects the ability to taste. Since anosmia is a sometimes irreversible and permanent condition, the Zicam lawsuits are seeking damages accordingly.
A Dow Jones Newswire article in February 2004 reported the FDA was investigating consumer complaints regarding zinc gluconate induced loss of smell. Matrixx Initiatives quickly responded by saying it was not aware of an FDA inquiry into the safety of its Zicam products and possible Zicam side effects. Zicam, LLC is a wholly owned subsidiary and it produces, as well as markets and sells Zicam Cold Remedy. In addition to Zicam Cold Remedy, the company has an entire Zicam line that has been successful, with revenue in the third quarter ending September 30, 2003 increasing 163% to $13.4 million from $5.1 million in the comparable year ago period.
