Yaz Birth Control Class Actions

A Yaz birth control class action is a lawsuit filed on behalf of more than one person who was harmed by Yaz birth control, the oral contraceptive that was approved by the FDA for three distinct purposes:

as a contraceptive
as a treatment for moderate acne in women who are using Yaz as a contraceptive
as a treatment for PMDD (premenstrual dysphoric disorder) in women who are using Yaz as a contraceptive

Individual Legal Actions vs. Class Actions

Many women have reported problems they developed after starting the Yaz regimen (24 days on active pills, four days on inactive pills). A number of legal actions have already been initiated to recover the losses suffered by women whose health was damaged by Yaz, such as:

medical bills
lost income
loss of ability to work
permanent disabilities

There has been no published report of a Yaz class action as of March 2009, but it is entirely possible that the coming months may bring such an action, as the number of women and families harmed by Yaz side effects continues to rise.

Benefit of a Yaz Class Action

Although any woman (or her survivors) can take legal action against the makers of Yaz (Bayer Corp.) for damages due to this drug, a class action may be a better option. The purpose of class actions is to combine the yaz birth control lawsuits filed by people in similar circumstances, and thus "streamline" the legal process by having many people's legal actions heard in one court at one time.

Many States' Attorneys General Acted

Twenty-seven states' Attorneys General joined together in a single legal action in 2007 regarding Yaz birth control and the Yaz marketing used by Bayer. They and the FDA saw that the Yaz television commercials were promising too much for Yaz, suggesting that Yaz could cure symptoms for which it is not approved.

Yaz Marketing Settlement

Bayer agreed to stop that particular ad campaign and they agreed to conduct a new, $20 million "corrective" marketing campaign with new commercials and print advertisements that clarified that Yaz birth control pill does not:

treat mild acne or help keep your skin clear
cure the symptoms of PMS (premenstrual syndrome)

Bayer also agreed (among other things) to:

submit an annual report about Yaz to each participating Attorney General's office
submit all of their new Yaz direct-to-consumer television ads to the FDA for pre-review
stop making any claims about Yaz that are not FDA-approved
