It is a well-known national statistic that women earn less than men, specifically 76- cents on the dollar for what a man makes. Wal-Mart''s workforce is over two-thirds female, yet less than one-third of its managers are female and in every department of the store women are paid less than men. Sexual discrimination against women has been fought through the courts and history-altering decisions removing sex-based restrictions on occupations were achieved. Many people continuing to fight against sexual discrimination against women hope that the Wal-Mart lawsuit will bring even more necessary changes to the workplace and force the public as a whole to scrutinize the way our system is set up.
The certification of the class action has been viewed as a victory to the potential 1.6 million current and former female employees it could represent, but to successfully prove any case of sexual discrimination against women is very difficult. Due to the enormity of the case, the difficulties could be even greater. Sexual discrimination against women cases are notorious for being difficult to prove. In addition to having to prove the women were doing their jobs, it must also be shown that the employer made negative decisions against them based on their sex.
Originally filed in 2001, the suit charges sexual discrimination against women occurred in pay and promotions. The National Organization for Women (NOW) believes Wal-Mart will finally be held accountable for its sexual discrimination against women reported and that other women facing the same problem should be encouraged that effective remedies exist. As the Wal-Mart lawsuit continues, there will be much public scrutiny and can even cause other large and small corporations across the nation to reevaluate if their work environment may be fostering sexual discrimination against women.
