Brain injuries often result from accidents, whether in an automobile, workplace or other situation where trauma can occur. Brain injury law is put into effect when another party is responsible for the accident.
Brain injury law can encompass cases that involve any of the following: automobile accidents, truck collisions, bicycle collisions, pedestrian knockdowns, falls, falling objects, unsafe premises, chemical exposures, electrical injuries, workplace injuries, and playground injuries.
Approximately 50 percent of all traumatic brain injuries result from an automobile accident. When another driver''s negligence or an automotive defect is responsible for the accident, brain injury law allows for a settlement for the accident victim. Examples of automotive defects that may result in brain injury include: faulty airbags that activate too soon or too late; inadequate roof crush protection in rollover cases; and lap-only seatbelts in the backseat.
Driver''s negligence is often to blame in automobile accidents in which the brain injury victim was rear-ended at a high speed. Passenger cars that are hit by a truck can sustain more severe damage because of the heavy weight of the striking vehicle. Pedestrians or bicyclists who are hit by a motor vehicle can also hold negligent drivers accountable for a brain injury sustained during the collision or subsequent fall. Bicyclists have also won settlements against manufacturers of defective bicycle helmets.
When using brain injury law in fall accidents, it must be proven that the fall was not the fault of the accident victim, but rather the result of environmental factors or hidden hazards that were not clearly marked by a property owner. Property owners can also be held accountable for brain injuries that occur as a result of falling objects not safely secured on their premises. Property owners have a legal responsibility to provide a safe, well-maintained area. This includes circumstances where people can be exposed to harmful chemicals or electricity, which can also cause brain injuries. Victims of brain injury accidents that occur on another person''s property can sue landlords, property managers or property owners for negligence.
Workers'' compensation laws also come into play in brain injury law cases. Employers are obligated by law to provide brain injury victims with benefits that include temporary disability payments, medical evaluations, medical care, vocational rehabilitation, permanent disability payments for the partially disabled and life pensions for the totally disabled. They are also obligated to return the employee to his or her job after recovery time. Attorneys experienced in brain injury law can help ensure that workers'' compensation laws are followed.
