A disabled Arkansas woman will receive $250,000 from Wal-Mart Stores Inc. for damages related to her 2003 termination from one of the company's Aberdeen stores, according to an announcement by the U.S. Equal Employment Opportunity Commission.
Not Willing to Accept Demotion
Glenda Darlene Allen, a pharmacy technician, had worked for Wal-Mart since 1993. In 1994, she was shot during a robbery at her second job and suffered spinal cord damage. Her injury resulted in an abnormal gait and the need for use of a cane.
According to Allen, Wal-Mart accommodated her until a new pharmacy manager was hired. The new manager tried to demote Allen in 2003 to door greeter and she was fired when she refused the demotion, attorney Christopher Marts said.
Disability Discrimination Settlement
The $250,000 discrimination settlement includes $50,000 in back pay, $50,000 in attorney fees and $150,000 in compensation, said EEOC attorney Maria Salacuse.
This case marks the second settled this year regarding the company’s violation of the American’s with Disabilities Act. The EEOC secured a $300,000 settlement for a disabled job candidate who was refused employment with Wal-Mart.
