Two men, injured in a Texas trucking accident were awarded $1.5 million. Ronny Martinez, 37, and Kenneth O’Neal, 50, were traveling on the highway in Waxahachie, Texas, July 2, 2006, when an 18-wheeler drifted into their lane and hit their vehicle. The collision sent their vehicle spinning out of control, causing it to roll several times.
Both men suffered serious injuries in the trucking accident. O’Neal suffered mild traumatic brain injuries, damage to his collarbone and a serious knee injury which led to multiple surgeries. Martinez fractured a vertebra.
After sustaining serious injuries, Martinez and O’Neal filed a personal injury lawsuit against the Indianapolis-based trucking company, Celadon Trucking Services Inc., who owned and operated the truck. The lawsuit stated that the trucking company was negligent to hire Michael Wade, the driver responsible for the truck wreck.
The men were awarded a total of $1.5 million for their losses. They received $750,000 for medical expenses and another $750,000 for other damages such as physical impairment, disfigurement and pain and suffering caused by the accident.
"These two men were driving down the road, minding their own business, when the Celadon driver changed their lives forever," says attorney James Craig Orr, Jr. of Heygood, Orr, Reyes, Pearson & Bartolomei in Dallas, who along with attorney Luis Bartolomei represented Martinez and O'Neal. "The jury did the right thing here. This decision will help them put their lives back together, and we hope it serves as an important warning to other trucking companies to hire only qualified drivers and follow the rules of the road."
