"SD Nursing Home Has Been Fined Before"
A nursing home in the San Diego area is being sued for the wrongful death of a 94-year-old resident who was hit by a car while under the care of the facility.
The Lawsuit
Maria Cobian had been a resident of Palomar Heights Care Center since May 2005. On Thanksgiving 2007, she wandered outside the facility and into a traffic lane where she was hit. According to a report, Cobian had a history of trying to leave the nursing home.
Her son, Alberto, filed a lawsuit against Palomar Heights claiming the facility failed to “supervise and ensure” Cobian’s safety. The suit also names the driver of the car that hit Cobian and the owner of the vehicle, Hidden Valley Security Services.
The suit is seeking more than $25,000 in damages.
Citations Issued
Palomar Heights Care Center was fined $100,000 in January by the California Department of Public Health for violations related to Cobian’s death.
In 2006, the facility received another citation related to the death of a resident who burned to death. He had been smoking while connected to an oxygen tank.
