San Francisco city officials have agreed to settle a medical malpractice case for $5.1 million, reportedly one of the largest such settlements in the city’s recent history.
Incident at San Francisco General
The settlement stems from an incident at San Francisco General Hospital in 2005. According to court documents, John Weatherspoon III, who was 40 at the time, went to the hospital complaining of a cough and fever that had lasted a week.
Weatherspoon was diagnosed with acute renal failure and treated with sedatives, court documents allege. Documents also claim that hospital staff failed to monitor Weatherspoon as he continued receiving sedatives, and he experienced heart and lung failure as a result.
Serious Brain Damage
A medical examination showed that Weatherspoon was “down for nine minutes,” causing him to suffer severe brain injury that now requires round-the-clock care.
In February 2006, Weatherspoon was transferred from San Francisco General Hospital to Laguna Honda Hospital. The settlement will be used to pay for medical care for the rest of his life.
The mayor has yet to approve the terms of the settlement.
