"Rottweiler Mauling Suit"
A woman and her son filed a lawsuit over several serious dog bites . The Evansville Housing Authority, Animal Control, and the City of Evansville had been warned several times about a dangerous rottweiller but did nothing, which led to the attack, the suit states.
Misty D. Davis claims her son, eight-year-old Shawn Davis, was viciously attacked because the city entities failed to act.
The Attack
According to the records of the Davises' attorney, Daniel Tuley, Shawn was playing on EHA property when the dog pounced and began to maul him. Shawn's stepfather came out to assist him, but he had suffered severe bites by that time.
Pictures of Shawn after the attack show deep gashes and missing chunks of flesh on his arms, back, shoulder, and torso. The skin had a yellow tint to it, and there was bruising.
Shawn had to stay in the hospital for three days. He then had to undergo a month of hydrotherapy – a painful treatment in which the boy sits in a spa full of antibiotics to clean the wounds. Tuley noted that Shawn screamed in pain during the treatment at times.
The medical bills came to a total of $16,000.
Preventable?
Tuley said the mauling was preventable because Animal Control was “well aware of this dog's violent propensities based upon numerous prior attacks.”
Animal Control records showed that the dog had attacked a young girl who knocked on its owner's door in Aug. 2004.
Tuley interviewed neighbors, and learned that some of them had also complained to the EHA about the violent dog before the attack on Shawn. Other neighbors had been bitten by the dog but did not report the incidents to Animal Control.
“(EHA) could have forced the owners to get rid of the dog or face eviction,” Tuley explained.
