The parents of a boy who was recently killed on a dirt racetrack have filed a suit claiming their son was wrongfully killed.
JMX Racing LLC and JMX Racing Promotions Inc. were named as defendants in the wrongful death lawsuit.
Cody Fidler had been a lover of motorcycles from a very young age and began riding dirt bikes when he was only three years old.
However, on March 10, 2007, his life was abruptly cut short when he was involved in a fatal bike accident.
On the day of the accident, Filder was participating in an organized motorcross practice when a larger motorcycle, that supposedly wasn’t supposed to be on the track, crashed into the boy.
Soon after the incident, the boy’s parents, Michelle and Wade, decided to take legal action against the racetrack.
The suit claims that the larger bike was not legally supposed to be on the track at the time and due to their negligence their son’s life was cut short.
“You cannot put into words the pain that comes,” explained Michelle. “You never expect to bury your five-year-old son. I miss him so much.”
The family says they have filed the suit to prevent such tragedies from happening to other families and to get word out about safe racing.
