The decision comes approximately nine months after the U.S. Supreme Court ruled that Missouri inmate, “Jane Roe,” had the right to have an abortion. Last summer, the state stopped providing transportation for inmates wanting an abortion, except in life-threatening circumstances.
The American Civil Liberties Union requested a federal judgment to make the high court''s decision a class-action valid for all pregnant inmates in the state. Yesterday, U.S. District Judge Dean Whipple granted the request.
ACLU attorney Tom Blumenthal was pleased with the decision, saying that the judge''s ruling affirmed the rights of prisoners as well as the rights of pregnant women.
