A jury found Tuesday that the hormone replacement therapy drug, Prempro, manufactured by Wyeth, caused a woman's breast cancer, awarding her and her husband a $3 million verdict.
A previous jury also found Wyeth guilty in the same case, but that verdict was thrown out when the judge declared a mistrial. This led to the retrial, which was finalized yesterday.
Jennie Nelson took Prempro for six years before she developed cancer. She had to undergo a double mastectomy, and she required regular chemotherapy and radiation treatment.
The Trials
The jury at the previous trial at the Philadelphia Court of Common Pleas had awarded Jennie Nelson, and her husband $1.5 million in damages. In this trial, the couple was awarded $3.1 million – $2.4 million for Jennie, and $600,000 for her husband.
“Both times this case has been heard on terms established by Wyeth and still the juries have clearly found that Prempro causes breast cancer,” said Tobias Millrood, the Nelsons' attorney.
Other Lawsuits
Wyeth is facing about 5,000 other lawsuits against it over its hormone replacement therapies. These drugs have been used by millions of women to treat the effects of menopause.
Even though a major government-sponsored health study found that using HRT for five years or longer can increase the risk of breast cancer, the drugs remain on the market.
