A federal judge recently allowed a lawsuit to take place against the East Haven, Connecticut police department. The lawsuit alleges that the police department failed to protect a woman from her estranged husband, who shot and killed her in July of 2000.
The woman, Josephine Giaimo, was at an outdoor concert at the time of her death. Her husband, Frank Cosenza, shot himself and died after killing his wife. The police had records of two reports of domestic abuse, and also knew that Cosenza had guns and had threatened to kill his wife. Cosenza also had a restraining order against his wife. The case will ultimately hinge on whether or not the police knew that Cosenza wanted to kill his wife.
The ruling by the judge opens the door for the family of the young woman to figure out whether the police could have prevented her death. The death of Giaimo prompted some city and state officials to call for tougher gun seizure laws. Cosenza’s guns had not been confiscated, even after repeated police problems.
