Texas couple Jan and James Callihan filed a lawsuit against six petrochemical companies, claiming the products the defendants produce and distribute exposed James to unsafe levels of benzene. They allege this exposure is what caused James to develop acute myelogenous leukemia.
The suit points out that the benzene containing products James Callihan was exposed to during his 20-year career as a journeyman laborer were:
"Defendants through their various agents, employees, and representatives were negligent in failing to properly manufacture and in failing to warn plaintiff James Callihan and those situated of the adverse effects of benzene," the suit says.
Six petrochemical companies have been included in the lawsuit as defendants. They are:

The Callihans allege that James’s leukemia developed as a result of repeated use of the defendants’ benzene containing products. The suit predicts that James’s leukemia is likely to become terminal over time. It describes James’s injuries as “permanent” and “disabling.”
"The conduct of the defendants indicates a conscious disregard for the health, welfare, and safety of others and has resulted in untold human suffering, (and) needlessly sacrificed lives.”
The consequences of benzene exposure can be deadly. Benzene has been shown to cause rare forms of leukemia, including acute myelogenous leukemia.
Although using benzene in the U.S. as a solvent has been banned for many years now, workers using solvents continue to be exposed to benzene because it is still present in some degree in most petroleum solvents.
