The manufacturer of the popular antidepressant Paxil is facing yet another lawsuit filed by a South Carolina couple who claim the drug directly caused their daughter to suffer a birth defect.
Product Liability Lawsuit
When Kimberly Dismuke was pregnant in 2000, her doctor advised her to stop taking her heart medication. However, nothing was said about Paxil, an antidepressant that has been prescribed to millions of patients worldwide.
Sadly, her daughter, Taylor, was born nine months later with a heart malformation that required her to undergo open heart surgery twice before her first birthday.
Kimberly and her husband, after hearing of Paxil birth defect risks, filed a products liability lawsuit against pharmaceutical giant GlaxoSmithKline alleging they weren''t warned that the drug, when used by pregnant woman, can cause serious birth defects.
The couple also claim they were specifically told that Paxil would not harm the baby.
Paxil Risks
In September 2005, a survey released by GlaxoSmithKline revealed that woman who plan on becoming pregnant or those that are pregnant who take Paxil have an increased risk of having children with heart malformations and other congenital defects.
According to the Dismuke family attorney, Taylor''s malformation was caused by Paxil. “We hope that it is the first case in this country to go to trial in which GlaxoSmithKline will be held accountable for its corporate decisions that place moms at risk of birth defects,” he said.
