A man who had a surgical procedure performed on the wrong side of his vocal cords is suing the hospital where he received the procedure and the physicians involved.
What Happened?
The 66-year-old cancer survivor had gone into St. Joseph''s Hospital for treatment for his left vocal cord, which had been left paralyzed by cancer treatment.
After the consultation, Larry Bimbo agreed to undergo a laryngoplasty – a procedure in which an implant is surgically placed against a damaged or paralyzed vocal cord to brace it and hold it closer to the functioning vocal cord, allowing for better vocal function.
Unfortunately, the doctors performed the procedure on the wrong vocal cord seriously hindering his ability to speak, swallow, and even breathe.
“This mistake could have killed him, said the attorney representing Bimbo, Christopher Piekarski. “His health absolutely deteriorated while he was under their care. The standard of care was violated.”
The law requires medical practitioners and all people who perform acts that may conceivably harm others to exercise an appropriate level of prudence and care to ensure that no one does get hurt.
After the errant procedure, Bimbo was forced to undergo two subsequent procedures: one to remove the implant from his healthy vocal cord, and another to properly place an implant where the first one should have been placed.
Bimbo seeks unspecified general damages in his lawsuit, but the dollar amount is not specified.
