A new Ortho Evra lawsuit has been filed in California against the manufacturer and others involved in the development of the birth control patch, which has been the cause of thousands of serious adverse events in the U.S.
Forty-six plaintiffs—most of which are women in their teens or early twenties—are named in the personal injury lawsuit against Ortho McNeil.
The lawsuit claims these women suffered severe side effects directly resulting from the use of the patch including stroke, blood clots, and even death. In one case, an otherwise healthy 23-year-old woman who wore the patch for only one month experienced deep vein thrombosis and died.
According to the suit and similar claims filed in other states, Ortho McNeil failed to warn doctors and patients of the increased risk of Ortho Evra birth control patch and should be held responsible for the damages incurred.
Ortho Evra Risks
Ortho Evra was approved by the Food and Drug Administration in 2001 and was prescribed to millions of woman in the U.S. In 2005, a report released by the Associated Press revealed information about the serious dangers linked to the birth control patch—dangers that were downplayed and/or ignored by the drug maker.
Further investigations found that patch users were exposed to 60 percent more estrogen than if they were taking the pill because the hormone goes directly through the blood stream, thus increasing the risk of:
Deep vein thrombosis (leg blood clots)
Pulmonary embolism (lung blood clots)
Stroke
