U.S. District Judge Rodney Sipple announced that he elected to use the defendants’ proposed Plaintiff’s Fact Sheet when filing NuvaRing® MDL lawsuits. The fact sheet requires all plaintiffs involved in NuvaRing® lawsuits to disclose their history of psychological or psychiatric counseling. Sipple is assigned to oversee all federal birth control ring lawsuits.
NuvaRing®, which is manufactured by Organon Pharmaceuticals, is a vaginal contraceptive that hit the market in the summer of 2002. The flexible ring slowly releases estrogen and progestogen over a three week period. Because it is easy-to-use, it has become increasingly popular among women.
Since it has hit the shelves, several women have filed personal injury lawsuits against Organon Pharmaceuticals, claiming the NuvaRing® has caused fatal blood clots and other serious conditions including:
All of the lawsuits involving NuvaRing® have been consolidated and are being overseen by Judge Sipple in the U.S. District of Missouri. Since he was assigned the NuvaRing® cases, Judge Sipple has been trying to categorize similar cases.
In an effort to effectively manage all the cases, a case management order was issued Nov. 7. The order stated that all plaintiffs who have filed personal injury lawsuits involving NuvaRing® must complete a Plaintiff Fact Sheet before Feb. 6, 2009.
Although counsel for the plaintiffs argued that their clients’ psychological and psychiatric history is irrelevant, Judge Sipple ruled that the questions are relevant and should therefore be filled out in a fact sheet before filing a case.
