An elderly victim of nursing home abuse has filed a lawsuit against a nursing home claiming it was negligent in the hiring and supervising of a janitor with a history of sexual abuse.
Violet Tilloston's suit against South County Nursing and Rehabilitation Center came after Saul A. Lanciero sexually assaulted her.
According to the lawsuit, the nursing home “discharged, transferred and/or retaliated against” Tillotson for reporting that she was sexually assaulted. It also claimed that the nursing home “condoned and/or attempted to conceal the sexual assault.”
The Mishandling of the Complaint
According to the suit, Tilloston told staff at the nursing home that the male janitor came into her room and put his hand between her legs. The staff then investigated and “the report was found to be unsupported.”
According to Tilloston, the nursing home officials then called her delusional and sent her out to a psychiatric unit.
She was picked up by an ambulance and taken to Our Lady of Fatima Hospital, and the personnel there were told that Tilloston “was suffering from visual hallucinations and delusional ideations.” She was held in the psychiatric unit “on an involuntary basis” for two weeks.
Later, Saul A. Lancerio pled no contest to two counts of first-degree sexual assault, and one count of second-degree sexual assault for assaulting Tillosten and two other nursing home residents.
Lancerio's Past
According to the lawsuit, Lancerio was accused of “sexually assaulting a resident at another nursing home in Washington County prior to being hired by South County Nursing Home.”
The suit claims that the Washington county nursing home reported the allegation to the Health Department and the Alliance for Better Long Term Care, but the South County center never ran a check with those entities when they hired Lancerio.
Tilloston's lawyer, Jeffrey M. Padwa, said, “This is about protecting other residents. These nursing homes have to know they have to take some level of precaution and that there are eyes watching them.”
