After a two year old boy began to bubble at the mouth and fall into fits of a seizure, the boy was discovered to have severe lead poisoning from peeling paint in their Wayne County, Michigan apartment. Just over a year after the boy nearly died, the Wayne County Consumer Protection Task Force has announced an investigation and criminal charges against the owner of the apartment complex will probably be brought. If charges are filed, it will be the first time the county has prosecuted a landlord for failing to repair a lead paint hazard.
According to county officials, the landlord ignored over a dozen county orders to fix lead problems since August 2003. There are other facilities in Wayne County that have not answered letters to county orders, which may be charged as well. The charges are expected to be misdemeanor counts under a county ordinance requiring repairs to lead paint hazards in rental units. Hundreds of counts are possible, and for each day the problem was ignored will count as one. If the owner is convicted, 90 days of jail time and up to $500 fine per count could be ordered.
In 2002, more than 4,000 Michigan children suffered lead poisoning, according to the Michigan Lead Safe Partnership. This number excluded the nine out of 10 children younger than six that had not even been tested.
