Pfizer is the target of a class action lawsuit filed November 12 alleging the company violated the Illinois Consumer Fraud and Deceptive Business Practices Act. The suit is seeking up to $75,000 per class member with allegations that Pfizer failed to provide proper warning about its arthritis drug Bextra to doctors and consumers in package inserts and reference manuals for doctors. Barbara Mihalich filed the Bextra class action lawsuit.
Mihalich also alleges Pfizer spent a large quantity of money trying to convince doctors to prescribe Bextra while failing to disclose relevant scientific data that would allow doctors to make informed decisions about patient treatment plans. Pfizer''s misbranding of Bextra, according to Mihalich, allowed sales and profits to extend beyond what it should have had the company properly informed consumers and doctors of all the pertinent data.
Bextra is a cox-2 inhibitor class drug and has been on the market since its 2003 FDA approval. Pfizer''s two cox-2 inhibitor drugs, Bextra and Celebrex, are the only two remaining on the market today following the Vioxx recall a couple months back. Since the Vioxx recall, the safety of the entire class of cox-2 inhibitor drugs has been questioned and remain controversial.
