"Family of Lawnmower Death Suit Awarded $6 Million"

The family of a North Carolina man who died when a defective lawnmower exploded, was awarded $6 million in damages after a jury found the equipment company that manufactured the product liable for his death.

Jacobsen Division of Textron Inc., a named defendant in the lawsuit, was ordered by the jury to pay Charles “Dale” Smith Jr.''s family $2 million for the pain and anguish they endured as a result of his death including $2 million each to Smith''s mother and father.

What Went Wrong?

In April 2003, 36-year-old Smith was cutting grass on a riding lawnmower at his father''s business when it suddenly exploded causing him to suffer severe burns on almost half of his body. He died at the hospital four days later.

The family filed a wrongful death lawsuit in 2005 claiming that the mower was defective and dangerous.

“I think this was really a tragedy, it''s just had such a horrible impact on the parents and their lives,” said the plaintiff''s attorney Eddie Musselwhite. “There''s no amount of money that can compensate them for what happened.
