The arraignment of Juan Manuel Alvarez, the man who allegedly caused the fatal Metrolink train crash, resulting in 11 deaths and hundreds of injuries, has been delayed until February 15, according to the Los Angeles County District Attorney’s Office.
Alvarez has been charged with 10 counts of murder and possibly the death penalty. Alvarez’s lawyer asked for the delay due to his client’s medical reasons and asked he undergo a mental evaluation.
The capital murder charges filed against Alvarez are a rare and somewhat unprecedented use of a century old California law passed in 1905, making it a capital crime to derail a train and cause death. It was the basis of the “special circumstances” that make Alvarez’s crime eligible for the death penalty.
