A man filed a personal injury lawsuit against an Illinois construction company and one of its employees after sustaining injuries in an auto accident last year. Mark Ochao filed the lawsuit claiming he suffered serious injuries after PVC pipe flew off the bed of a flat bed truck and crashed through his windshield in May 2007.
Ochao claims defendant Robert S. Anstedt, a Kilian employee, was driving east bound down Highway 161 May 25, 2007 in a 2002 Silverado that was loaded with PVC pipe in the bed of the truck. According to the suit, Anstedt hit the breaks and the load of 4-inch PVC pipe flew off the truck and shot into on-coming traffic.
The pipe smashed through the windshield of Ochao’s 2002 Mercedes, resulting in serious injuries to the head, neck, face, hand and shoulder. He was traveling in the opposite direction at the time of the accident.
Ochao was treated in the hospital for his injuries including fractures in his face. The lawsuit claims he lost his sense of smell in the accident as well.
Ochao is suing the defendant for negligence and is blaming Anstedt for not properly securing the PVC pipe. He claims if the pipe was fastened properly and if Anstedt was driving more cautiously, he would not have suffered the injuries.
Ochao is seeking sums in excess of $300,000 in the personal injury lawsuit against the construction company and the driver.
