On Sept. 19, the mother of a Woodstock, Illinois nursing home resident filed a wrongful death suit on behalf of her son who allegedly died from a lethal dose of morphine. The former owners of the Woodstock Residence facility and two nurses were named as defendants. The lawsuit is the second to follow a police investigation of suspicious deaths of residents at the nursing home.
John Sherman died in September 2006 at the Woodstock Residence, and nurses Marty Himebaugh and Penny Whitlock were indicted in April 2008 on charges of criminal neglect. Himebaugh is alleged to have administered excessive doses of morphine to Sherman, and Whitlock is accused of failing to report the actions of Himebaugh. The two former Woodstock Residence employees are not accused of intentionally killing John Sherman or any of the other deceased patients.
Sharon Hunt, John Sherman’s mother, filed the lawsuit in McHenry County Circuit Court. The defendants named are Himebaugh and Whitlock; WRHC & RC Inc., which held the license for the Woodstock Residence; Dr. Gurbax Saini, Sherman's doctor; former administrator Alissa Nataupsky and Kathy Gallias, a nurse practitioner.
