A Texas seafood processing plant has had a wrongful death suit filed against it for failing to provide medical help for a man who was injured while working at their facilities.

Man’s Death Caused by Blow to the Head

Sidnitra Bias has filed a wrongful death lawsuit against Gulf Harvest Seafood on behalf of the estate of Sidney Carroll Prevost Jr.

Prevost died at the company’s facility last September after suffering a knock to his head while performing his usual work duties. After receiving the blow to his head, he asked his superiors to take him to the hospital, but instead they told him to lie down in the break room.

Later in the work-day, the unsupervised Prevost was found dead in the break room.

Wrongful Death Suit Claims Death was Preventable

The suit alleges Gulf Harvest was guilty of negligence and could have prevented Prevost’s death. The suit asserts that the company’s neglectful reaction to the situation caused Prevost’s death.

The suit states that Gulf Harvest committed the following acts of negligence:

• They did not seek proper medical aid for Prevost
• They did not monitor his condition after he hit his head
• Employees were not properly trained
• No set procedures had been implemented to handle situations where employees require medical attention
• Improper supervision of employees

Damages Suffered as a Result of Death

In addition to the wrongful death claim, the lawsuit claims that Bias, who was involved in a relationship with Prevost, has suffered damages related to his death. These damages include:

• Loss of Prevost's care, maintenance, support, services, advice and counsel
• Incurred funeral costs
• Loss of love
• Loss of companionship
• Loss of society and support
• Experienced mental anguish
• Loss in inheritance
• Loss of consortium

Bias seeks an unspecified amount in damages and legal fees from the defendant, Gulf Harvest Seafood.
