Kyle "Dusty" Foggo, 53, the former third-highest ranking officer of the Central Intelligence Agency (CIA) pleaded guilty to one count of wire fraud on Sept. 29 as part of his plea agreement, with prosecutors dropping the other 27 counts against him. Foggo admits that he used his position in the CIA to direct hefty defense contracts toward a friend who then gave him tens of thousands of dollars' worth of gifts.
Foggo was responsible for the CIA's daily operations from 2004 to 2006. The case against him arose from an investigation of Randy "Duke" Cunningham, the former Republican congressman in California who is now in prison for taking bribes from Brent Wilkes, a defense contractor and long-time friend of Foggo.
The federal prosecutors in Foggo's case stated that Foggo accepted as much as $70,000 in gifts from Wilkes such as expensive dinners and free vacations for him and his family, and that Foggo had a standing offer of high- paying employment with Wilkes if Foggo ever left the CIA. In return, Foggo helped Wilkes' company get many CIA contracts while concealing Wilkes' connection.
Although Foggo remains free on bond pending his January 2009 sentencing, he faces up to 20 years in prison. A more likely sentence from the U.S. District Judge, James Cacheris, is the three-year term recommended by federal prosecutors. Foggo's plea deal was arranged just a few weeks after Foggo apparently threatened to expose the confidential covers of CIA agents, according to prosecutors.
