"Geogia Man Doesn't Have to Pay Back Support"
The Georgia Supreme Court ruled that a man who fathered twins with a Florida woman in 2000 does not have to pay $426,000 in back child support.
Out-of-Court Agreement
Willie Gary, a successful lawyer who lives in a $6 million home and owns a private jet, reached an out-of-court child support agreement with Diana Gowins in July 2002. Gary agreed to pay $14,000 a month for each child, but he later argued that he intended the $14,000 to cover both children.
Superior Court Judgment
In July 2005, a Fulton Superior Court judge upheld the terms of the original agreement and ordered Gary to pay $28,000 a month in child support. Gary had been paying at least $14,000 a month since 2002, but Gowins wanted him to pay the $462,000 he hadn’t paid for the other child.
Supreme Court Ruling
However, the State Supreme Court on Monday ruled that superior court judgment “did not include an award of back child support.”
“I’m thrilled. Justice is being done,” said Tamar Oberman Faulhaber, Gary’s attorney.
Robert Moss, attorney for Gowins, said the money could potentially be collected “through some other enforcement action.”
