Nearly 10,000 signatures and letters in support of passing tougher New York drunk driving laws will be given to state Assembly Speaker Sheldon Silver by two Queens mothers November 16. The stricter New York DWI laws are in response to a man being charged with just a DWI, carrying a maximum sentence of one year in prison if convicted, despite leaving an 11-year old boy dead and another child disabled.
Right now, under New York state laws, drunk drivers who kill or seriously injure someone cannot be charged with a crime harsher than a DWI if authorities cannot show the drunk driver was doing something else illegal at the time, such as speeding. The mothers hope to get enough support to close the New York DWI loophole, which is being termed “Vasean''s Law” after the now deceased 11-year old boy. Vasean''s Law would remove the requirement that a second element be present for a stiffer charge to be sentenced against drunk drivers that kill or severely injure innocent victims.
