The Utah House is currently pursuing a bill that would cut the state''s legal drinking limit for drivers with children in their vehicles to half that of those who are driving alone or with other adults.
House Bill 128, sponsored by Rep. Dana Love, R-Syracuse, would lower the legal blood alcohol limit required for DUI charges from .08 to .04 if children are in the car. That means that consuming two drinks in an hour could result in jail time for persons driving with children.
Some feel that the bill is draconian and ineffective in protecting children from drunken drivers in other cars. Utah Attorney General Mark Shurtleff has refused to endorse the bill until he sees how the public reacts to it, and state representatives of Mothers Against Drunk Drivers have also refused to support the bill.
