The small Texas town of Dalworthington Gardens recently began having police officers take blood samples of suspected drunk drivers. Officials in the town maintain that the new policy will speed up blood alcohol level results and arrests in drunk driving cases.
In many cases, police officers have forced the suspects to get the blood drawing beyond their wills. Police say that the method is a form of search warrant. The blood sample is a way that they can search the suspect for alcohol content.
Dalworthington Gardens is the only city in Pantego County, probably the only in the country, instituting this new policy. Police and officials from the small town say that they are having problems dealing with drunk drivers being unwilling Breathalyzer, or other, DUI tests.
Police say the new policy helps in DWI cases because often blood alcohol level is contested in court.
There are, however, several issues, which make this new practice controversial. First, police officers are often not properly trained in medical issues such as blood drawing and test results. Secondly, the constitutional rights of the suspect may have been illegally impeded by the new tests. Having a government official demand a blood sample during a traffic stop may be against the laws of the country.
