Four Denver area janitors have filed a federal lawsuit against the Durango School District in an unlawful firing based on racial discrimination. The four, ex-employees of Escalante Middle School, claim that they lost their jobs due to racial, rather than performance, reasons.
The four men, Angelo Albo, Tony Albo, Orlando Lujan, and Lady Skorski, claim that the school district has violated their rights as given to them by the US Civil Rights Act of 1964. They were fired in July of 2004 from the school.
The Albos, brothers, both worked for the school for over 20 years. Lujan worked there for more than 15 years and Skorski was hired in 2003.
Problems arose when the four got a new supervisor, Thomas Dickson. Mr. Dickson, according to the lawsuit, repeatedly used racially motivated hate speech and abuse directed toward the four due to their Mexican and Native American backgrounds. Mr. Dickson is currently on leave until November during the initial stages of the investigation.
The firing happened after a custodian fainted on the job and the four men were placed on suspension for possibly violating safety procedures. The four janitors were fired on July 14 of last year and a subsequent appeal to regain their jobs was denied later in the year.
The federal Equal Employment Opportunity Commission granted the four the right to sue after reviewing the case. The lawsuit seeks to have their jobs reinstated and to award them back pay and any other damages related to their discrimination and firing.
