An Oregon family was awarded $48,000 for damages suffered as a result of mistaken cremation.
The family of Pamela Grant, who died in February 2007 from a heart condition, filed a lawsuit against Holman Funeral Home and Oregon Crematory, claiming that Grant was cremated before they had a chance to say a final goodbye.
According to the complaint, the family had asked the funeral home to delay the cremation while relatives arrived from California. Though the funeral director instructed the crematorium about the delay, the body was cremated before the family could conduct a last viewing.
When several of the family members visited the funeral home and asked to see Grant, they were reportedly told by the funeral director that her body was too decomposed for viewing. After the family left, the funeral director called them to say Grant had already been cremated.
Grant’s family sued for emotional and punitive damages totaling $3 million. The jury found against the crematorium in the amount of $48,000.
