A lawsuit has been filed on behalf of 60,000 college students alleging that they were charged more tuition than illegal immigrants at state run colleges and universities in California.
The suit has been filed in Yolo County Superior Court and says that the policy of giving undocumented foreign students in-state tuition while charging US resident students from other states up to $10,000 more is a violation of federal law.
The lawsuit was started at the University of California, Davis and is asking for remuneration for fees that were overpaid and for damages due to discrimination. A federal law was passed in 1996 which mandated that all tuition at institutions of higher learning would be equal for out-of-state students and students from other countries.
In 2002 California began charging illegal aliens the same amount as California residents, up to $10,000 a year less in some instances.
The lawsuit seeks damages in the range of several hundreds of millions of dollars and names the University of California, California State University, and all state community colleges as defendants.
