"Man Awarded $3.9 M in Medical Malpractice Case"

A Staten Island jury awarded $3.9 million to a man who suffered severe medical problems after two doctors performed a botched surgical procedure that made his condition worse.

“No amount of money could make me feel the way I felt in court today, to hear that these doctors were guilty [of malpractice],” said plaintiff Brian Baslin. “I believe that justice was done.”

What Went Wrong

Baslin''s medical troubles started in early 2002 when he developed “arcuate ligament syndrome”—a condition in which the celiac artery, which pumps blood to the intestines, stomach, and other organs is compressed by a ligament that is attached to the diaphragm.

His ailment caused Baslin to suffer dramatic weight loss, nausea, vomiting, and severe diarrhea. In March 2002, he sought surgical treatment to release the pressure on the celiac artery.

Unfortunately, the procedure performed by Drs. Enrico Ascher and Sreedhar Kallakuri did nothing to ease Baslin''s discomfort.

A few months later, Baslin decided to undergo another operation with a different surgeon. However, the new surgeon was unable to access the artery because of the extremely dense scar tissue that resulted from the original procedure. The new doctor had no choice but to graft veins from Baslin''s legs to perform a bypass.

Medical Malpractice Lawsuit

Baslin filed a medical malpractice claim shortly after the second procedure alleging that the two doctors that performed his first surgery botched the operation causing him to suffer pain for the remainder of his life.

Baslin has developed incisional hernias, abdominal weakness, nerve damage from his vein removal surgery, and urinary tract problems. He also suffers from osteoporosis and will no longer be able to work.

The judge and jury who heard his case in trial found the two doctors guilty of medical malpractice and awarded Baslin a large sum in damages.
