"Birth Injury Lawsuit Settlement Reached at $35 Million"

After a woman gave birth to a severely handicapped son in October 1998, she filed a medical malpractice lawsuit. The birth injuries were a result of the doctors failing to quickly perform a C-section after realizing the baby was in distress, according to the lawsuit. The baby suffered serious brain damage and quadriplegia.

Lawyers claimed the doctor failed to respond to numerous pages by other doctors to help in the C-section and a nurse working the night of the birth testified that the doctor was with her in a private room when he ignored about three pages. The birth injury lawyers also claimed the doctor falsified hospital documents relating to time inconsistencies and eraser marks on his sign in sheet. The $35 million settlement is the largest birth injury settlement in Cook County, Illinois history.
