Ohio became the first state to require medical criteria be met before an asbestos lawsuit can be filed. Taking effect September 2, the asbestos ruling requires a plaintiff provide medical evidenc e proving asbestos exposure was a substantial factor for his/her illness. The administrative order is intended to give priority to asbestos cases filed by individuals already displaying illness.
The court order allows claimants who meet the asbestos medical criteria to continue with their claims in the regular tort system. However , individuals exposed to asbestos but n ot yet showing signs of illness will have their cases temporarily dismissed. If at a later time, the asbestos exposed claimants develop asbestos-related illnesses, the individuals can ask the court to reinstate the claims. If the already ill asbestos cases are resolved, the dismissed cases will be restored. There is no time limit for reinstatement of the dismissed asbestos cases.
