Allergan Inc. is being sued for failing to warn consumers of the dangers associated with Botox, the company’s blockbuster wrinkle treatment.
The Complaint
The lawsuit was filed on Wednesday on behalf of more than a dozen plaintiffs and alleges that Botox is responsible for three deaths and various injuries including difficulty breathing and swallowing.
“Botox is causing major injuries and death, and it’s well-documented but not widely known. So thousands of people are getting injections with no warnings to speak of. They fall ill with serious illnesses and, in some cases, they are not even aware that it’s the Botox that caused it,” said attorney Ray Chester.
Deaths Linked to Botulinium-Based Products
Earlier this year, the FDA said it was looking into reports of serious adverse reactions, including one death, in patients injected with Botox and its competitor Myobloc. The FDA statement came on the heels of a Public Citizen announcement revealing reports of 16 deaths linked to the two products.
According to the consumer group, 180 patients injected with Botox or Myobloc between 1997 and 2006 experienced life-threatening side effects.
Botox Uses
Botox is a purified form of the deadly botulinum toxin and is FDA approved to treat frown lines. However, Botox is frequently used for non-approved purposes such as treating migraines and relieving spasticity in cerebral palsy patients.
Sales of Botox exceeded $1.2 billion in 2007.
