Fosamax® (alendronate) is a bisphosphonate drug, a class of medications to treat and prevent thinning of the bones or osteoporosis. Postmenopausal women, who are at highest risk for osteoporosis, are the largest group of patients taking the medication, but premenopausal women and some men also take Fosamax®.
Fosamax® is also used to treat some patients who are taking corticosteroids, medications that may lead to bone thinning, and patients with Paget’s disease, an illness causing the bones to become soft, weak, or deformed, painful and easily broken. Eight million dollars was awarded to a Walton Beach, Florida, women, in the first lawsuit to successfully recover damages for taking Fosamax® and subsequently suffering ONJ. The award was decided at the end of June 2010 by a federal court jury in New York City.
The patient had used Fosamax® from 1997 to 2006 and eventually suffered from dead jaw. Merck & Co., the manufacturer of Fosamax®, said in a press release that the award was unjustified and excessive.
Merck, reportedly, is expected to file post-trial motions in September to overturn the verdict and will probably appeal the decision if the motions are not successful. Merck plans to have the $8 million verdict reduced or dismissed it said in a press release issued the same day as the verdict came down.
Merck said the women’s history of long-time smoking and severe periodontal disease predated her use of Fosamax®. Information about the lawsuits given by Merck said about 1,039 cases, which included 1,417 plaintiff groups, had been filed and were pending against the company in either federal or state court.
