Fosamax® (alendronate) is a medication prescribed to combat osteoporosis and prevent fractures of the bones. It is in a class of drugs called bisphosphonates. These drugs are intended primarily to increase bone mass and reduce the risk of fracture in patients with osteoporosis.

The number of lawsuits against Merck, the manufacturer of Fosamax®, has been increasing. By the end of March 2010, about 1,039 cases were pending, which included approximately 1,417 plaintiff groups.
A Walton Beach, Florida, woman 71, received an $8 million award in June 2010 from Merck for her ONJ. The trial was considered a “bellwether” or test case trial. The first trial of this case ended in a mistrial in September 2009 when the jury deadlocked, unable to agree if Fosamax® was the cause of the woman’s ONJ and if Merck should be held liable.
