Lawsuits have arisen in response to deadly effects that railroad workers have been exposed to. Creosote is a possible human carcinogen primarily used in railroad ties and as a wood preservative. In December 2003, the EPA released a preliminary risk assessment for creosote. Although the EPA stated there needed to be further studies, the possible exposure to a carcinogenic toxin for all these years could escalate into a high number of FELA lawsuits.

FELA Law Protects Injured Railroad Workers

The creation of FELA, the Federal Employers Liability Act in 1908 was created in order to provide protection to railroad workers injured on the job. Under FELA, railroad workers have sought to recover damages. During the legal pursuit, a FELA deposition will be required in order to have the events of the case documented. The written or recorded testimony can be used in court should the case make it that far.
