Many Digitek lawsuits have been initiated across the U.S. based on Digitek overdoses and side effects that have caused serious illnesses and fatalities. Digitek's manufacturers, Actavis Totowa, Mylan Bertek and UDL voluntarily recalled this heart medication in April 2008 in light of confirmed reports of excessive amounts of the active ingredient (digoxin) in Digitek tablets.
Another Digitek recall was announced in March 2009 by manufacturer Caraco Pharmaceutical Laboratories, again based on dose variability of the Digitek tablets. The tablets may be larger than intended or contain an overdose of digoxin, the toxicity of which can cause life-threatening heart malfunction.
The U.S. Food and Drug Administration (FDA) had warned Actavis in 2007 that:
"Significant deficiencies were found in the operations of your firm's quality control unit, and as a result there is no assurance that many drug products manufactured and released into interstate commerce by your firm have the identity, strength, quality and purity that they purport to possess."
In the fall of 2008, many of the post-Digitek recall lawsuits around the U.S. were combined into a multi-district litigation (that is, a class action) in the U.S. District Court of the Southern District of West Virginia. The March 2009 recall will most likely bring on more Digitek recall lawsuits, and the plaintiffs in these lawsuits may be eligible to join the Digitek class action.
