DePuy Orthopaedics has been under fire since the company announced a recall of the ASR™ XL Acetabular System and the DePuy ASR™ Hip Resurfacing System. Both of the hip replacement systems have been linked to severe pain and injury leading to revision surgery in certain patients. Since the systems were approved in July 2003, they have been implanted in numerous patients.
DePuy issued a recall of the products after reviewing data that showed that roughly 12 percent of all patients who received the ASR™ resurfacing device and 13 percent of patients who had received the ASR™ total hip replacement system experienced pain and other symptoms requiring revision surgery within five years of initial surgery.
NOTE: The DePuy ASR™ Hip Resurfacing System is not available in the U.S. So, for the purpose of this site, we will only discuss the ASR™ XL Acetabular System, which has been available, worldwide, since 2003.
Metal-on-metal hip replacement refers to a type of hip replacement implant that is made of metal components. There is a metal ball and socket that rub against each other. This action causes small metal particles to shed off the system into the body. In some cases patients will not be bothered by the shreds of metal (they are very small and can only be seen using a microscope).
However, some patients may have an ill reaction, and may experience a buildup of fluid in the joint and surrounding muscles. Over time, the fluid can result in painful swelling. If untreated, patients may experience permanent damage. Proper treatment requires revision surgery.
If you have an artificial hip, which was implanted after July 2003, you should contact your doctor to find out if you have a recalled DePuy ASR™ XL Acetabular System. If you do, DePuy suggests you contact them for more information about the recall. The company says it will cover "all reasonable costs" of testing to make sure your metal-on-metal hip implant system is working correctly. Or, if you need revision surgery, the company says it will pay for that as well.
If you are among those treated with a recalled hip implant, you should consult with a legal professional after receiving proper medical treatment to find out if you qualify to recover additional compensation for your pain and suffering. Our attorneys are available to discuss your individual circumstances and are accepting new cases on behalf of patients nationwide.
DePuy Orthopaedics was founded in 1895 as the first commercial orthopaedics company in the U.S. Since the company was founded, it has created and designed multiple devices for the hip and knee, among other body parts. As a medical device company, DePuy Orthopaedics has a certain responsibility to American consumers. When something goes wrong with its product, we believe the company should be held accountable.
As a result, our attorneys have taken a special interest in the injuries caused by the recalled metal-on-metal hip replacement systems. DePuy has agreed to pay for the medical costs associated with replacement surgery for patients who were treated with a faulty hip replacement system. However, we believe that is not enough. Our attorneys are dedicated to helping injured patients recover financial compensation for their pain and suffering, in addition to financial loss.
If you or someone you love has suffered as a result of a faulty DePuy ASR™ XL metal-on-metal hip replacement system, you may qualify to seek compensation for your medical costs, pain and suffering. For more information, contact our DePuy hip replacement attorneys today.
