DePuy Orthopaedics, a subsidiary of U.S.-based global healthcare company Johnson and Johnson, has recalled two of its hip products: the ASR™ XL Acetabular System and DePuy ASR™ Hip Resurfacing System. The DePuy ASR hip systems are implanted during hip replacement surgery. The hip implants recalled are those implanted in July 2003 and after.
The DePuy ASR hip systems are being recalled because they have been failing much faster than hip implant systems should. Patients who received defective hips are required to undergo a second replacement surgery.
Under the hip implant recall, patients are directed to call their surgeons to find out if they received the DePuy ASR hip. If they have, they are to undergo testing to see if their hip product has failed. Signs of failure include pain in the joint area due to the DePuy hip loosening and causing bone, muscle, soft tissue and even nerve damage. Pain may also be felt in other areas of the body. Patients will likely have trouble walking due to the failure.
For patients who are not experiencing symptoms, blood tests will indicate if the metal-on-metal DePuy ASR hip has gone out of alignment and is rubbing, creating microscopic metal debris in the blood. The metal causes a negative reaction in some patients that may require a second replacement surgery even in the absence of symptoms. Concerns about metal toxicity and cancer causing metals spreading through the bloodstream have surrounded the hip implant recall.
DePuy is promising some reimbursement of expenses related to the recall, including initial testing and replacement surgery. As the testing and claims process has just started it's not known what standards for approving claims will be followed. No compensation for pain and suffering is being offered.
Patients concerned about their rights should contact a DePuy hip implant attorney to make sure their rights are protected. You may be entitled to compensation for medical treatment over and above what the company is willing to provide under the hip implant recall. Patients who require revision surgery might also be entitled to recover compensation for their pain and suffering.
The recovery process may be long and painful. You should be compensated for the pain you are caused. To find out if you qualify, contact our DePuy recall lawyers today.
