Two types of hip replacement implants distributed by DePuy Orthopaedics, a subsidiary of U.S.-based global healthcare company Johnson and Johnson, have been voluntarily recalled by the company after an unacceptable number of patients who received the hip implants were required to undergo additional invasive surgery to repair failures of DePuy hip implant.
The failing devices are the ASR™ XL Acetabular System and DePuy ASR™ Hip Resurfacing System that were implanted in 2003 and after.
DePuy Orthopaedics reports that patients who received defective DePuy ASR hip implants may encounter symptoms that continue or recur after the initial post-surgery recovery, including:
When the DePuy hip implant has problems, breakage of the bones in the hip area could occur, as well as damage to other bones, muscles and nerves. Recall attorneys are warning that debris from the defective ASR hip implant may contain cancer-causing materials that spread through the bloodstream.
While DePuy Orthopaedics has said that they may cover some out-of-pocket expenses related to the hip implant recall, including initial testing and replacement surgery, they have not released any details. It is possible that many costs will not be covered and that claims will be denied even where the surgeon has found problems with the ASR hip implant.
DePuy has also not said whether the money has to be paid out by the patient or insurance company before being reimbursed. DePuy has only said that it will pay the undefined "reasonable and customary" expenses to the patient and insurance company for initial testing and revision surgery. The company has not said whether and how much it will repay Medicare for additional treatment and revision surgery.
DePuy Orthopaedics has, notably, not disclosed whether they will cover the potentially 3-months long recovery or whether they will cover surgery if the patient chooses not to receive a hip implant made by DePuy Orthopaedics.
No offer of compensation for pain and suffering has been made by the company.
