Information about Darvon® Lawsuits

Darvon® and Darvocet® are narcotic painkillers with a long history of serious side effects. Both contain propoxyphene, the active ingredient responsible for the damage the drugs have done to thousands of users. In addition to propoxyphene, Darvocet® contains acetaminophen, a weaker analgesic that increases the efficacy of propoxyphene.

Because of the serious injuries the drugs have caused, the U.S. Food and Drug Administration (FDA) requested that they be pulled them from the market. Makers of Darvon® and Darvocet®, Xanodyne Pharmaceuticals Inc., recalled the medications on Nov. 19, 2010. Propoxyphene has many side effects that have the potential to harm nearly every system in the body. But, the most serious damages and the reasons the FDA recalled Darvon®, are:

• Its effect on the electrical activity of the heart, sometimes leading to lethal rhythm abnormalities
• The potential for overdosage, both intended and unintended, which could lead to suicide or accidental death

Now that these drugs have been recalled from the market, not only in the U.S., but also in the United Kingdom and across the European Union, those injured by the drug and their loved ones are filing lawsuits against the drug maker Xanodyne Pharmaceuticals Inc. Even before the recall, when the dangers of the drug were clear, many patients were filing lawsuits against the manufacturer.

Class Action Lawsuits Against Darvon®

According to reports, On Dec. 3, 2010, Linda Gallagher filed a Darvocet® class action lawsuit against Xanodyne. Darvocet® contains propoxyphene in combination with acetaminophen. Darvon®, which hit the market first in the 1950s, contains propoxyphene without the added acetaminophen. The suit was filed in the U.S. District Court in New Orleans, alleging that the medication caused her heart damage. Gallagher had two heart attacks since 2007 when she first started taking the drug.

The proposed class action represents Gallagher and others like her who were harmed by propoxyphene-based drugs, and accuses the manufacturer of:

• Making a drug that could significantly harm its users and thus violates the Food, Drug, and Cosmetic Act
• Failing to warn physicians and patients of the possible risks of taking the medication

The proposed lawsuit is asking for:

Gallagher is believed to be the first person to file a class action lawsuit against Xanodyne for damage caused by propoxyphene drugs.
