product_liability crash_worthinessMost motor vehicle accidents are caused by negligent driving on the part of one or more of the parties involved, but in some cases, auto defects cause or significantly contribute to accidents. In addition to causing accidents, problems related to auto defects can create an unsafe vehicle, such as poor electrical wiring, which can cause fires. Manufacturers may be held responsible for auto defects and be required to pay for the costs of the victims.
Auto defects usually fall into one of two classifications: manufacturing problems, or design flaws. Manufacturing related auto defects occur when the vehicle is improperly assembled, despite proper design. For instance, auto defects such as the misplacement of the fuel tank or failure to properly attach seat belts are considered manufacturing defects if the design of the vehicle called for proper installation. Auto defects that fall into the design category happen when the vehicle is poorly or improperly designed, for instance, if the designer fails to include a roll bar. If manufacturers were aware of auto defects (whether related to the design or the assembly) and did not adequately inform consumers of those auto defects and their potential outcomes, then those manufacturers can be held accountable for "failure to warn.”
If auto defects cause or contribute to the death or injury of a person, the manufacturer may be held liable. Laws regarding auto defects vary by state, but the statute of limitations for injury due to auto defects is generally two years. That means that if you suspect that you or a loved one was killed or injured because of tire or auto defects, you have two years from the date of injury to file a claim. If it is determined that auto defects are responsible for all or part of the damages, the manufacturer may be required by law to pay for medical costs, lost wages, pain and suffering, and punitive damages. Claims involving auto defects can be require specialized knowledge, and it is strongly advised that you retain an attorney who has experience representing persons injured by auto defects.
