Defective Chinese drywall lawsuits are being filed in increasing numbers as numerous complaints about noxious Chinese-made drywall are lodged with state health departments across the U.S., especially in the southeast. The complaints involve matters such as:
The defective Chinese drywall is suspected of emitting toxic levels of compounds that are bad enough to corrode metal and cause serious injuries in people exposed to the defective drywall, including:
As more and more American consumers begin to recognize the signs and symptoms of the defective Chinese drywall, the number of lawsuits and class actions involving the defective product are increasing. For instance, a Florida Defective Chinese Drywall class action suit was filed in Cape Coral against Engle Homes, a company that is alleged to have constructed Cape Coral homes using drywall from China — the country where so many other products have been found to be dangerous (including tires, toys, food and furniture).
Two other class actions (one in Florida, another in Louisiana) are underway against a company that includes a drywall manufacturer in China. Knauf Gips KG, a global group of companies that make and sell building materials, is based in Germany but has plants, mines and quarries around the world — including China.
These and other defective drywall lawsuits also name as defendants the building companies and/or developers responsible for the construction of their homes. However, these defendants themselves are sometimes plaintiffs in defective drywall lawsuits of their own, contending that the drywall products they purchased for use were not as advertised.
For example, a builder named the Mitchell Company, based in Alabama, has filed a class action defective drywall lawsuit alleging that Chinese-made drywall they used in 40 homes the company built in Alabama and Florida in 2005 and 2006 caused the odor and corrosion problems described above. A lawyer representing Mitchell Co. noted, "We filed on behalf of builders because we believe...they're going to be the ones with the initial loss."
